By using the services of Delta 74 Private Investigations Limited you agree to the terms and conditions set out from here within.

1. Definitions

1.1 ‘You’ refers to any client of Delta 74 in any capacity, be it private individuals or companies. ‘Us’ ‘our’ ‘our staff’ or ‘we’ refers to Delta 74 Investigations Limited and its employees in any capacity.

2. Services

2.1 Delta 74 will start and stop services as agreed by both you and us prior to the service being carried out.

2.2 Services to be carried out will be completed in accordance with instructions given by you either in writing or verbally.

2.3 Delta 74 will provide services in the most effective and efficient way possible however, we are paid for time on an investigation and not the outcome as the wanted outcome cannot be guaranteed due to a multitude of factors outside of our control.

2.4 The Delta 74 tracing service is a no find no fee service however the fee must be paid upfront and in full. On a no find result a full refund will be issued to you. 

2.5 No find results include where Delta 74 can not locate that person to an address within the United Kingdom or abroad. Finding a person through our trace service who is deceased is not classed as a no find result. 

2.6 The Delta 74 tracing service no find no fee guarantee is only applied when we cannot locate a person to an address. The Delta 74 tracing service does not include having to locate a person’s contact details such as phone number and email or any social media accounts. We will always endeavour to locate this information as part of our service however we only agree to locate a person to an address. 

3. Information

3.1 From you, Delta 74 will ask for your personal details to include name and place of residence and a photographic ID. This is part of our due diligence and we reserve the right to cancel and stop services being provided if we deem our services are being employed out of the law or in a way that is unethical or immoral.

3.2 Delta 74 will ask you to provide personal information for an investigation to move forward. As a minimum, you agree to provide us with; a name for the subject of investigation, date of birth and age, travel details, current living or work address if known and photographs for identification.

3.3 Delta 74 are registered with the Information Commissioners Office (ICO) registration number – ZA342693 and the data controller is Daniel Burke. All information is held in accordance with the Data Protection Act 2018 and the General Data Protection Regulation.

4. Payment

4.1 We shall both agree a price before any services are rendered to you.

4.2 As a private client, you will make payment to us in full and before any services are rendered unless in extreme circumstances for example, where time constraints apply.

4.3 As a corporate client, you will be invoiced before or after services are rendered and invoices will be paid within 14 days of being sent.

4.4 Any costs incurred during an investigation will be invoiced to you to be paid within 14 days of the invoice being sent.

4.5 Where any amount outstanding is not paid within the payment terms, fees will be added as per our statutory right to claim interest (at 8% over the Bank of England base rate) and compensation for debt recovery costs under the Late Payment legislation. 5. Cancellation

5.1 Cancellation in from you will need to be in writing and accepted by us no later than 48 hours prior to when services are due to begin. A full refund will be issued if a case is cancelled no later than 48 hours before an investigation (in any capacity) is due to start.

5.2 If an investigation is cancelled within 48 hours of an investigation starting Delta 74 reserve the right to not issue a full refund.

5.3 Delta 74 reserve the right to cancel an investigation at any time and without warning but circumstances must be severe to not issue a full refund.

5.4 If at any point during services being rendered by us and any member of our staff become in danger or asked to be placed in a situation where risk is greater than reward, Delta 74 reserve the right to cancel the investigation without issuing a refund.

6. Liability

6.1 In no event, shall Delta 74 be liable for any loss of profit, loss of business, loss of data, or any other losses sustained by you, the client.

6.2 In no event, shall Delta 74 be liable for any damages sustained by you, the client.

7. Confidentiality

7.1 Delta 74 will treat all information passed to us as confidential and will not be passed to any third party unless instructed by you, requested by an authority possessing the correct legal documentation or requested by a court of law.

7.2 All information kept with regards to an investigation will be held in accordance with UK Data Protection Laws.

8. Communication

8.1 Communication between us and you will be within the terms agreed as set out from the first enquiry. For security reasons during an investigation please make us aware of any immediate issue in regards to forms of communications.

9. Governing Law

9.1 You agree to fully comply with any laws, taxes or tariffs applied in any way to services rendered by us.

9.2 You will defend Delta 74, its staff, sub-contractors and agents from any claim, suit, penalty, tax, fine, or tariff or any failure to comply with any such laws, taxes and tariffs, whilst operating on behalf of the client.

10. Complaints

10.1 We at Delta 74 hope that you would not need to use the complaints procedure however if this the case please direct any complaint to us in writing and we will look to solve the matter in the most timely and effective manner in a way that is most beneficial for all parties involved.
